Our goal at FOREVER® is to preserve family memories to be enjoyed for many generations. When using our Digitization service you may not always know what is on the items you are sending in, so sometimes your audio disc or video tape may contain copyright information. Here is a brief overview of how we handle copyright content when we come across it.
DRM Protected
A large majority of movies, TV shows, and music have special protection built in that stops people from copying or sharing them beyond the existing format. This protection is called Digital Rights Management (shortened to DRM).
The only way to find out if a disc or tape has this protection is to start digitizing it. If our technicians find out the item is DRM protected (either a portion or in its entirety) then we can’t complete the process, as breaking DRM protection is illegal under DMCA Law. Since the work has already been done to discover this restriction, we aren’t able to offer a refund or credit.
To avoid the possibility of this happening to your Digitization Project:
- Only send in audio/video you or your family made yourselves (like home movies).
- Make sure you have the right to share it (such as purchased souvenir videos).
- Or contains a known family member (like in a news segment).
By following these tips you can help make sure your Digitization Project goes smoothly and we can provide digital copies of all the memories you have sent in. For more detailed information you can refer to our Terms of Service, section 8 "Copyright Policy" - www.forever.com/tos
Simple Copyright
Alternatively, the item's content may be safeguarded under copyright laws, but do not have DRM protection. In these cases we will digitize the item and provide the entire copy of digitized content. It is then your responsibility to make sure you have permission to save, store, and share your digitized content. Furthermore, you understand that you must delete any copyrighted content from your account that you are not legally allowed to listen to, view, duplicate, or use.
